What is the Can-Spam Act?

A law that applies to all commercial email messages to prevent unsolicited email communication.

To comply with the Can-Spam Act, email senders must:

  • Inform recipients where the sender of the message is located (a physical address)
  • Identify the message as an ad
  • Avoid using misleading subject lines
  • Provide the option for recipients to unsubscribe
  • Honour opt-opt requests in a timely manner
  • Monitor others who have access to their subscriber list (i.e. a marketing agency)

Every email which violates the CAN-Spam Act can be subject to a $50,120 fine making non-compliance extremely costly.
